Nothing contained on this Website shall create a brokerage relationship, agency relationship, fiduciary relationship, or representation agreement unless expressly established through a separate written agreement.

The execution of a Buyer Agency Agreement is governed solely by the terms of that separate agreement and not by these Terms of Use.

  • Use information obtained from the Website to avoid payment of commissions, referral fees, or compensation owed to participating real estate professionals;
  • Introduce a third party to a property opportunity for the purpose of avoiding brokerage involvement;
  • Attempt to negotiate directly with owners or their representatives regarding opportunities introduced through the Website;
  • Use Website information for competing services, lead generation, solicitation, or commercial purposes.

The obligations contained in this section shall survive termination of Website access and remain in effect for twenty-four (24) months following the user's last access to Confidential Information.

Users acknowledge that unauthorized disclosure or circumvention may cause immediate and irreparable harm to NomadX LLC, PremarketHome.com, participating brokerages, agents, builders, developers, sellers, and property owners.

Accordingly, NomadX LLC shall be entitled to seek injunctive relief, temporary restraining orders, specific performance, equitable relief, and all other remedies available under law without the necessity of proving actual damages.

The parties acknowledge that damages resulting from unauthorized disclosure or circumvention may be difficult to calculate with precision. Therefore, if a user:

  • Discloses Confidential Information without authorization;
  • Circumvents PremarketHome.com, NomadX LLC, a participating brokerage, or affiliated real estate professional;
  • Facilitates the acquisition of a property opportunity through unauthorized means; or
  • Assists a third party in acquiring a property opportunity introduced through the Website,

the user agrees that NomadX LLC shall be entitled to recover liquidated damages equal to the greater of:

  • (a) Four Percent (4%) of the purchase price of the affected property; or
  • (b) Twenty-Five Thousand Dollars ($25,000),

plus reasonable attorneys' fees, investigation costs, expert witness fees, court costs, enforcement expenses, and any additional legal or equitable relief available.

The parties agree that these amounts constitute a reasonable estimate of anticipated damages and are not intended as a penalty.

NomadX LLC expressly reserves all legal and equitable rights and remedies arising from misuse, disclosure, misappropriation, or circumvention of Confidential Information.
